Terms of Use

These terms are a binding agreement between you and QuickSell GH. By creating an account or using the app, you accept them. If you don't accept them, don't use the app.

1. Who we are

QuickSell GH is a classified advertising app operated by Synergy Consult SMC ("QuickSell GH", "we", "us", "our"), based in Accra, Ghana. "You" means the person using the app. "The app" means the QuickSell GH mobile application and everything available through it.

These terms work together with our Privacy Policy and our Safety Tips, both of which form part of this agreement.

2. Who can use QuickSell GH

To use QuickSell GH you must:

• Be at least 18 years old
• Have the legal capacity to enter a binding contract under Ghanaian law
• Not be a person we have previously suspended

You may hold one account only. If you're registering for a business, you confirm you're authorised to bind that business to these terms.

3. Our role — and what we are not

QuickSell GH provides a place where users publish advertisements and contact each other directly. That is the whole service.

We are not a party to any transaction between users. We do not:

• Process, hold, escrow, guarantee, or refund any payment. Payment is arranged entirely between you and the other person, outside the app.
• Own, possess, inspect, test, value, store, insure, deliver, or transfer any item advertised
• Manufacture, import, distribute, or sell anything on the app
• Verify that a seller owns what they're selling, that an item exists, that it works, or that it's described accurately
• Verify the identity of any user, unless a listing carries a "Verified" badge — and see section 13 for what that does and doesn't mean
• Act as agent, broker, auctioneer, dealer, valuer, or estate agent for anyone
• Take commission on any sale

Any contract to buy or sell is formed solely between buyer and seller. Disputes about an item, a price, a payment, a delivery, or a refund are between those two people. We're under no obligation to get involved, and if we choose to help informally, that doesn't make us a party to the dispute or create liability on our part.

4. Your account

Provide accurate information when you register, and keep it accurate. You are responsible for:

• Keeping your password secret and secure
• Everything done through your account, whether or not you did it
• Telling us immediately at stunnerconsult@gmail.com if you suspect someone else has access

Do not give false information about your identity or your location. Do not sell, rent, share, or transfer your account. Do not create a second account to evade a suspension or a limit.

You may delete your account at any time from Settings → Delete account, or by emailing us. See the Privacy Policy for exactly what deletion removes.

5. Posting an ad

Each time you post, you represent and warrant that:

• You own the item, or are lawfully authorised to sell it, and have good legal title to it
• The item is real, exists, and is in your possession or control, and is located in Ghana
• Your description, price, photographs, and location are accurate, complete, and not misleading
• The price is exact. If the price depends on a variation — size, colour, condition — say so in the ad rather than advertising the lowest figure and revealing the rest later.
• The photographs are of the actual item and are yours to use — not taken from another listing, a manufacturer's website, Google, or someone else's ad
• The phone number is yours, works, and you consent to it being shown publicly to buyers
• Selling the item is lawful in Ghana, and you hold any licence, permit, or registration the law requires
• You will take the ad down or mark it sold once the item is no longer available

Post in the correct category. Don't post the same item repeatedly to climb the feed. Don't use ad text to advertise a different platform, website, or business.

We may ask you to substantiate a listing — for example, to confirm you hold a licence you've claimed, or that you own what you're advertising. If you can't or won't, we may remove the ad.

6. Prohibited items and content

6.1 Illegal and dangerous goods

• Firearms, ammunition, explosives, and their component parts; imitation firearms
• Offensive weapons, including knives offered as weapons
• Narcotic drugs and psychotropic substances; drug paraphernalia
• Prescription medicines; unlicensed, expired, or counterfeit medicines; unregistered health products; "miracle cures"
• Hazardous, toxic, radioactive, or flammable materials
• Anything that encourages reckless or illegal use of weapons

6.2 Stolen, restricted, and protected goods

• Stolen property, or goods whose ownership you cannot establish
• Counterfeit goods, replicas passed off as genuine, pirated media, or anything infringing a trademark or copyright
• Ivory, pangolin scales, bushmeat, and other protected wildlife or products made from protected species
• Human remains, organs, blood, or bodily fluids
• Government-issued documents, identity documents, licences, certificates, or uniforms
• Unrefined gold, minerals, or anything whose trade requires a licence you don't hold
• Currency, cheques, or financial instruments
• Tobacco, and alcohol offered without the required licence

6.3 Prohibited services and schemes

• Sexual services, escort services, or any sexually explicit material
• Pyramid and Ponzi schemes, "money doubling", investment schemes, get-rich-quick offers
• Loans, "susu" collection, or financial services offered without a Bank of Ghana licence
• Spiritual, occult, or "money ritual" services
• Academic cheating services, hacking services, or the sale of accounts
• Jobs that require the applicant to pay a fee
• Any service whose provision is prohibited by law

6.4 Living things

• Human beings, in any framing whatsoever
• Animals for fighting, baiting, or cruelty
• Protected or endangered animals

6.5 Prohibited content

• Nudity, pornography, or sexually suggestive imagery
• Graphic violence or gore
• Hate speech, or content attacking people on grounds of ethnicity, region, religion, gender, disability, or sexual orientation; content promoting ethnic conflict
• Harassment, threats, defamation, abusive or vulgar language
• Calls to violence or unlawful action
• Other people's personal data — including photographs of people who haven't agreed to appear, and any information identifying a child
• Ads that are purely promotional — brand advertising, "DM for details", or a business card with no specific item or service offered at a stated price
• Links or references to competing classifieds platforms
• Malware, phishing links, or anything designed to defraud

7. How you must behave

You must not:

• Harvest other users' contact details. The phone numbers on this app are published so that buyers can contact sellers about a specific item — nothing else. Collecting, scraping, exporting, or compiling users' phone numbers, names, or any other data, whether by hand or by software, is prohibited. So is using those numbers for bulk marketing, cold calling, spam, or resale to anyone.
• Use bots, scrapers, crawlers, or any automated system to access the app or extract listings
• Interfere with the normal operation of the app, or attempt to bypass our moderation or security rules
• Upload viruses, worms, trojans, or other malware
• Copy or redistribute another user's photographs or ad text without their consent
• Send unsolicited commercial messages, chain letters, or Ponzi schemes to other users
• Impersonate anyone, or misrepresent your connection to any person or business
• Abuse, threaten, or harass another user, or our staff

8. Review, rejection, and removal

Every advertisement is reviewed by a person before it becomes visible. Ads sit as "Under review" until approved. We aim to review promptly but guarantee no turnaround time.

We may reject or remove any ad at our discretion, with or without a stated reason, and without notice — including where an ad breaks these terms, is in the wrong category, has unusable photographs, looks fraudulent, is the subject of a valid intellectual property complaint, is the subject of a court order or a lawful demand from an authority, or where we simply judge it unsuitable. Where we reject an ad we will normally show you a reason in My ads.

We may also change, suspend, or withdraw any part of the app at any time, with or without notice, and we're not liable to you for doing so.

9. Reporting and blocking

Every listing has a Report button. If you see something breaking these terms, report it — that reaches our moderators faster than email. We review reports and may remove content or suspend accounts as a result. We're not obliged to tell you the outcome.

Every listing also has a Block seller button. Blocking hides that seller's ads from your feed immediately, without waiting for us. It's private to you, the other person isn't told, and you can undo it.

Don't file reports in bad faith, to damage a competitor, or as harassment. Abusing the report system is itself a breach of these terms.

10. Suspension and termination

We may suspend or terminate your account, and take down every listing you have, if:

• You breach these terms
• We reasonably suspect fraud, scamming, or illegal activity
• You abuse, threaten, or harass another user or our staff
• You attempt to bypass our moderation, our security rules, or a previous suspension
• You hold duplicate accounts

This list isn't exhaustive — we may also act where we reasonably judge it necessary to protect other users, third parties, or the integrity of the app.

Suspension may happen without prior notice. If you think we've suspended you in error, email stunnerconsult@gmail.com and we will look again — a person, not an algorithm, will read it.

Where you've paid for promotion on a listing removed for breaching these terms, no refund is due. Suspension doesn't end the obligations you already owe us, and we keep a record of it — see our Privacy Policy for why a suspended user can't simply delete and re-register.

11. Your content and the rights you give us

You keep ownership of your photographs and ad text ("your content"). We claim no ownership of it.

By posting, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, resize, adapt, and display your content for the purpose of operating and promoting QuickSell GH — including displaying your listing in the app and featuring it in our own marketing or social media about the app.

This licence ends when you delete the content, except that we may keep copies where section 8 of our Privacy Policy allows, and we cannot recall copies other users have already saved.

You are solely responsible for your content. You warrant that it doesn't infringe anyone's rights and doesn't breach any law or any duty you owe someone else.

12. Intellectual property complaints

If you own intellectual property rights — or are authorised to act for the owner — and you believe a listing on QuickSell GH infringes them, email stunnerconsult@gmail.com with the subject line "IP complaint" and include:

1. Your name, address, phone number, and email
2. What right you own — the trademark, copyright work, or other right — and evidence you own it
3. Which listing infringes it. Give the ad title and seller name, and attach a screenshot.
4. What specifically is infringing — a copied photograph, a counterfeit product, a misused brand name
5. A statement that you believe in good faith the use is not authorised by the owner or the law
6. A statement that the information in your complaint is accurate, and that you're authorised to act for the rights holder
7. Your signature — electronic is fine

We'll review and, where the complaint is valid, remove the listing. Repeat infringers get suspended.

If your listing was removed and you believe that was wrong, reply to us with your reasons and evidence of your right to sell the item. We'll reconsider. Filing a knowingly false complaint — to remove a competitor, for instance — is a breach of these terms and may make you liable to the person you targeted.

13. Paid promotion and verification

QuickSell GH is free to post on. We may offer paid features:

• Promotion tiers (such as VIP, Diamond, or Enterprise) — a coloured border and higher placement in the feed for a period
• Verified seller badges

Where offered:

• Promotion affects placement and appearance only. It does not guarantee views, enquiries, or a sale. We don't refund on the basis that a promoted ad didn't sell.
• A "Verified" badge is not a guarantee of honesty. It records that we made a limited check at a point in time. It is not a warranty about the seller, the item, or any future dealing. Don't lower your guard because of a badge.
• Payments are handled by third-party payment providers, not by us — their terms govern the payment itself. We never see your card or mobile money details.
• Fees are non-refundable once a promotion is live, except where Ghanaian law requires otherwise.
• We may withdraw a badge or promotion at any time, without refund, where the listing or the seller breaches these terms.
• We may change our fees and payment methods at any time. Current prices are shown in the app.

14. Taxes

You are solely responsible for determining, declaring, and paying any tax arising from what you sell through QuickSell GH — including any obligation to the Ghana Revenue Authority. We don't give tax advice, don't withhold tax, don't collect it on your behalf, and don't report your sales to anyone. If you're trading rather than selling personal items, speak to an accountant.

15. Advertising in the app

QuickSell GH is funded by advertising supplied through Google AdMob. We don't control which third-party ads appear and don't review, endorse, or warrant the products, services, or claims in them. Your dealings with any third-party advertiser are entirely between you and them, and we're not liable for any loss arising from them.

16. Safety

You will be meeting and transacting with strangers. Read our Safety Tips — they're short, specific, and the advice in them is drawn from how people actually get defrauded on classifieds platforms in Ghana.

17. Disclaimers

To the fullest extent Ghanaian law permits:

• QuickSell GH is provided "as is", "as available", and "with all faults", with no warranties of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
• We don't warrant that the app will be uninterrupted, timely, error-free, secure, or available at any given moment, or that defects will be corrected.
• We make no warranty about any listing or any user — the existence, quality, safety, legality, condition, value, ownership, or accurate description of any item; the ability of a seller to sell or a buyer to pay; whether any transaction will complete; or whether any item infringes someone's rights.
• We don't warrant that any advertisement will lead to a sale.
• Any material you download or obtain through the app is at your own risk.

Nothing here affects our obligations under the Privacy Policy or Act 843 — see that policy's section 14.

18. Release

You release us, and our officers, employees, agents, and successors, from all claims, demands, losses, and damages of every kind — known and unknown, including personal injury, death, and property damage — arising directly or indirectly out of your dealings with other users or with third-party advertisers.

19. Limitation of liability

To the fullest extent Ghanaian law permits, we are not liable for:

• Any loss arising from a transaction between users — money paid for an item never delivered, an item not as described, a fake, or a stolen good
• The conduct of any user, online or in person, including fraud, theft, assault, or any other criminal act
• Any indirect, incidental, special, consequential, exemplary, or punitive loss; or loss of profit, revenue, data, or goodwill
• Loss caused by content another user posted
• Loss caused by an interruption, bug, or data loss in the app

Where we are found liable despite the above, our total aggregate liability to you for all claims is limited to the greater of (a) what you have paid us in the 12 months before the claim arose, or (b) GH₵ 500.

Nothing in these terms excludes liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or under Act 843.

20. Indemnity

You agree to indemnify and hold us harmless against any claim, demand, loss, damage, or cost (including reasonable legal fees) brought by a third party arising out of: your use of the app; your content; your breach of these terms; your breach of any law; or any transaction you enter into through the app. We may assume the exclusive defence of any such matter at your expense, and you agree to cooperate with us.

21. Our intellectual property

The QuickSell GH name, logo, app design, text, graphics, and software are ours or licensed to us. You may not copy, modify, adapt, reverse-engineer, decompile, or create derivative works from the app, or use our name or logo, without our written permission.

22. Changes

We may update these terms at any time. The "Last updated" date above shows the current version. For material changes we'll give notice in the app. Continuing to use QuickSell GH after a change means you accept the updated terms. If you don't accept them, stop using the app and delete your account.

23. Governing law and disputes

These terms are governed by the laws of the Republic of Ghana, and any dispute is subject to the exclusive jurisdiction of the courts of Ghana.

Before starting proceedings, please email stunnerconsult@gmail.com. Most things can be sorted out informally, quickly, and for free.

24. General

• Entire agreement: these terms, the Privacy Policy, and the Safety Tips are the whole agreement between us about QuickSell GH.
• Severability: if any provision is held invalid or unenforceable, it is struck out and the rest stays in force.
• No waiver: if we don't act on a breach, we haven't given up the right to act on it later or on any other breach.
• Assignment: you may not assign or transfer these terms. We may assign them to a successor of our business, and by accepting these terms you consent to that.
• Force majeure: we are not liable for any failure to perform caused by something outside our reasonable control — including power failure, network or internet outage, failure of a third-party service we rely on, fire, flood, civil unrest, or act of government.
• No agency: nothing here creates a partnership, joint venture, employment, or agency relationship between us.
• Survival: sections 11, 17, 18, 19, 20, 21, 23, and this section survive termination of your account.
• Language: these terms are in English, and English governs any translation.
